A title report also shows any easements, or recorded legal rights to the property or portions of the property. For example, a previous owner may have legally given a neighbor the right to share the driveway, or the city may have a right to strips of the property for putting power lines, communication lines, water pipes, or sewer pipes.

In the United States, the buyer of a property will usually purchase title insurance, which protects the buyer from any title problems that may arise after sale (such as liens that were missed during the search). The title insurance company issues a report and issues an insurance policy in support of its findings.

A title search is also performed when an owner of a certain real property wishes to mortgage his property and the bank requires him to insure their transaction.

Generally, there are two main types of title searching, a full coverage search and limited coverage search; other types include non-insured reports and foreclosure guarantee search.

Full coverage search

A full coverage search is usually done when creating a title report for sale/resale transactions and for transaction that involves construction loans. It generally includes searches related to property lien, easements, CC&Rs covenants, conditions and restrictions, agreements, resolutions and ordinances that will affect the real property in question.

  1. Search for liens against the owner and the other parties on title.
  2. Search for liens against the buyer (for sale transactions only).
  3. Search for Bankruptcy proceedings against the owner of the property.

  • Search for liens against the buyer is not something that is covered in a title search.

Limited coverage search

A limited coverage search is usually done when making title reports for refinance transactions that involves ownership equity loans and for making simple title guarantee reports.

This kind of title searching usually includes searches for property liens, liens against the owner and the other parties on title and search for bankruptcy proceedings against the owner of the property.

Non-insured reports

There are a variety of title searches which provide the customer with a report, but no insurance. These are for informational purposes only, and are called by a variety of names, such as Lot Book Report, Plat Certificate, 300-foot Radius Report, and others. These informational searches are used mainly in two instances:

  • Probate. This is when a family, lawyer, or court is dividing up the property of a deceased person. Heirs will want to know what liens they are taking on and who has rights to the land.
  • Subdividing. To create a subdivision, a person takes land previously platted (legally named and recorded) under another name and renames and replats it as a new development or subdivision. A report must be given to the city, showing taxes paid and no liens. The owner can then sell the lots individually or en masse, and may record Covenants, Conditions, and Restrictions, which govern how residents may construct their houses or yards, and may limit other activities. Many subdivisions have noise, pet, and trash laws as well.

Foreclosure guarantee search

A foreclosure guarantee is a type of report (e.g. trustees sale guarantee, judicial foreclosure guarantee and litigation guarantee) that is used mainly for foreclosing an encumbrances (or a lien) in a certain property. The title searcher will perform a full coverage search to the property in default and a search for the addresses of the lien holders to the property in default. The addresses will be used for sending copies of the notice of foreclosure letters (such as notice of trustees sale, etc.) to the lien holders to the property in default.

Property Title Search before Foreclosure Sale

Let’s first understand how the property happened to be in foreclosure. A common reason is that current owners did not pay their mortgage or tax bills on-time, causing bank or municipal/state/federal government to place a lien against the property, in other words, the mortgage lender or government wants to get payment on the current owner’s obligations by any means, even if they have to go through the foreclosure expense and auction the house to recover the owed amount or gain possession of the house to sell it latest via real estate agency (REO properties).

If the current property owner had a single lender, then the amount you see at the foreclosure auction might be the only debt against this property (key word is might). In the case where the current owner had, say, a home equity loan in addition to home mortgage(s), there may be two or more liens against the property from different mortgage lenders. Whichever lender files “notice of default” first and puts a lien against the property gets to foreclose on the property first. The payout from foreclosure action to lenders or government always happens in order of court filing. The only way for you, as an investor, to find out what liens, mortgages, debts exist against the property is to order a Property Title search.

Foreclosure auctions (sometimes called sheriff’s sale) are typically held in the municipal (county) courts. The County does not offer you any protection against additional liens on the property, nor do they guarantee you a clean title.

In spiritual language this means man’s desire to become independent of God, to become a god to himself (Gen.3:5), and to lay out his life at his own will and pleasure. This is in great contrast to the prayer, "Give us this day our daily bread," which acknowedges a constant dependence on God.
    After deciding to go away from home, a little while is spent in reflecting before actually setting out. This is the spiritual history of one who says that there is no God, and that he will set up an opinion for himself. His conduct is compared to that of men who forsake the fountain of living waters for broken cisterns that hold water (Jer.2:13).
    The spiritual is among those who deny the existence of God means a want of truth, sincerity and love-the true nourishment of the soul.
    He "joined himself to a citizen of that country" probably means that he tried to frame a new system of faith and belief in his apostate condition. Nimrod did the same thing.
    Such a fall, so low in guilt and misery, is an extreme case, but is possible to any soul after the first downward step.
    This parable might very well have a new title, for it is really a Soul’s Tragedy.
    In the darkest hour of his troubles" he came to himself." His first thought was of his father, the fountain of spiritual truth and life.
    There are many today that are searching for truth but the truth is right in front of them.
    They use Mysticism and words like esoteric and say this is what we need a more understanding of truth.
    The New Age Movement is one of these movements that like Adam and Eve want to be as Gods.
    There is no way we could ever think or feel like or know His ways.
    Our love is nothing compared to His love.People search for a better understanding of God’s word when in truth "You must be born again" is the only truth. When you really become a child of God He will show you the truth. "The Truth will set you free"

  • That story has nothing at all to do with Satan. It is a type of the backsliden christian. That is a person who once had a relationship with Jesus but chose to walk away, then realizing his/her mistake, returned to the family.

  • Er why can’t you read it as just an analogy of how God is so loving that even when someone who knows him goes of the rails so the speak he is still waiting there with open arms and total unconditional love and forgiveness to welcome them home. Also don’t forget the older brother was extremely jealous of his brother on his return – this is a classic example of how some Christians have levels of sin and judge others accordingly. Sin is Sin and by the very fact that someone judges someone else a sin has been committed. To me this is a simple story. and many of us are grateful for it being included in the bible. It is also a warning to other Christians not to judge the ones that have apparently ‘fallen away’. God always goes looking for those lost sheep – it make take years – but he will find them and bring them home. Sometimes its just better to read it as it says and not bring too much super spiritual stuff into it. Don’t forget Jesus told this parable and he spoke in a way that was straight forward and easy to understand. he didn’t expect people to go looking for any in depth reason – he was just stating the obvious. Both brothers sinned one by going off on his own – and one being jealous. In fact the one going off was more open and honest whereas the other who stayed seemed to not only hold a grudge against his brother but also did his work out of duty. God wants us to do things out of Love not because of duty or a great reward. Our reward is knowing him – God waits patiently for all to come to him with open arms.Simple as that.

  • Actually, the hero of this story isnt the prodigal son, but rather the Father.

    Jesus is the one telling the parable, therefore, we can say that the Father represents God, and sinners represent the prodigal son.

    When the son ran out of money and was feeding the pigs, he didnt think of his father… The Bible says he thought of the food that the servants had to eat!

    Luke 15:17 "And when he came to himself, he said, How many hired servants of my father’s have bread enough and to spare, and I perish with hunger! "

    He was thinking of his belly! Was he repentant? I doubt so, for if he was it would have been phrased differently.. But I believe all scripture is God ordained and must be taken into context…

    So the son started to scheme and plot, rehearsing to himself what he would tell his father in order to earn some form of forgiveness.

    But unknown to the son, the father has been sitting at the highest place of the house day and night non stop looking out for the son since day 1 hoping for his return… the instant he appeared on the horizon the father lifted up his robes, fully showing his bare legs and sprinted to the son.

    By now the son is smelling of pigs but the father just keeps on smothering him with loving kisses..

    All the son managed to say was "i have sinned-" which is only a part of his rehearsed speech.. the father did not even allow the son to say make me a hired servant.. instantly the ring( authority) and sandals( slaves dont wear shoes.. ) and the best robes (righteousness) were bestowed upon him..

    Whats most beautiful is the fattened calf… Notice the father said to the servants, bring the fattened calf and kill it.. not in the kitchen, but where the son can see the death that paid for his sin..

    The son must see that someone paid for his freedom, authority, righteousness and sonship..

    I find it interesting that only a few lines are given to write about the boys sin, but a majority of the parable tells about his redemption..

    Thats how we know God… by listening to the word of Christ..

  • I agree with you. The prodigal son had an anti-Christ or satanic attitude such as the god of this world has when denying Christ. The father who welcomed him back was like God the Father who forgave him and loved him. This is try. When he was in his darkest hour he came to himself. This is the way it is, and hope my own grown children who have forsaken the fountain of living waters will also return to reality in Jesus very quickly.

    Yes, all parents who have been heart-broken by their children’s behavior will understand about this and rejoice when their children return.

  • It is about a Fathers love for his child, the child’s freedom of choice, no matter how unwise it may have been.
    A lesson learned the hard way, repentance of the son, forgiveness of the Father.

    He did not want to live under the guidance of his father.
    Rebellion is considered a sin in the Word of God.

    Living away from the Father means are resources are limited and quickly exhausted.
    Living with the guidance of our Father and living in His will, means we will always have abundance in Him. Not only in physical, material thing, but most important spiritual.

  • Bearing in mind that Jesus told this parable to the Pharisees who looked down on the "sinners" (in their eyes), the focus is on redemption of the lost son, as Spdcp said. Granted that God hates sin, and all have sinned and fallen short of His glory, God’s grace is greater than sin – "where sin increased, grace much more abounded." (Romans 5:20) When we behold our faults, it only leads to a downward spiral of depression. We need to be Christ occupied, not self occupied. When we behold the Lord’s glory, we are being transformed from glory to glory into His same image, by the Holy Spirit. (2 Corinthians 5:21)

    All glory to Jesus Christ and what He has done at the cross. The message of the cross is the power of God unto salvation – making us whole in every way. Satan has been defeated at the cross. Grace is greater than sin, just as Jesus is greater than the devil. The more we lift up the name of Jesus, the more we experience the manifestation of His victory in our lives – over sin, temptations, sicknesses, lack, unclean habits, Satan, death – and the more other people are drawn to Him. :)
